      I'm familiar with both cases, and that is a mischaracterization. If you want to see real Judicial Legislation, look up the Dredd Scott case, Wickard vs. Fillburn, Roe Vs. Wade, and the Obamacare "tax or fee" dilemma.

      No mention of Lochner, lol. That's the era we're headed back to: child labor laws are unconstitutional because conservatives judges say so. Take another look at those cases. (1) Shelby County invented a new rule, (2) Citizens United overturned an old rule.

      1. Not sure what rule was "added", but the issue with Shelby (like Roe vs Wade) was that it gives too much power to the Feds in state election rules. That power should be reserved for the states, not the federal, as long as the state rules don't violate federal laws.

      2. The campaign finance laws in regards to Citizens United was deemed inconstitutional because it violatex the 1st amendment. It also would never be used consistently: NRA gets way more flak than Planned Parenthood who gives way more in one year that NRA gives in ten.

      3. Now that I've adressed your concerns, how about mine. Do you support and reject all the decisions I brought up. There is no Constitutional or consistent way to puck and choose. Only pure tribalism is the only way to say Roe is correct but Dredd Scott is wrong.

      (1) The 14th amendment gives Feds express grant of authority. Roberts overruled because ...well, they've been trying to write out the 14th for a while now 2. Citizens United overturned an prior court ruling that said dark money flooding elections undermined public trust.

      3. I get that you're trying to link your animus to a woman's personal autonomy, but Roe v Wade, whatever its merits or demerits, has nothing to with Dred Scott.

      4. Indeed, from an originalist perspective, difficult to say Dred Scott was wrongly decided. The Founding Fathers were very racist and didn't intend Constitution to protect black people. Thankfully, 14th amendment in place now.

      Parts of Dred Scott were not originalist, and the originalist parts were not good originalism. The third section of the opinion, invalidating the Northwest Ordinance, was the origin of substantive due process & not defensible on originalist grounds.

          Originalism is all made up anyway. It doesn't mean anything except "ignoring the law to achieve outcomes desired by conservatives." Now that the Georgetown Prep Rapist is on the Supreme Court, Originalism is going to allow the President to decide criminal cases.
