Is there a way state residents can insure state regulators and research labs against lawsuits by the FDA?

He too mistakes the actual result of the regulatory regime—no one applies—with a different result (no one approved). It’s a very big difference.

You’re right that delay/cost/risk deters many credible groups from applying. That’s likely even more damage, though intangible & harder to measure. How many more producers would’ve built if we’d reduced friction? In this case though we *also* have tangible evidence of denials.

The FDA is indefensible as an arm of the corpratocracy. They don’t serve the public interest, they serve the highest bidding corporate interests. Cancer cure:https://youtu.be/qQKaCTdrmJc

You’d need tort reform as part of this package. Right-to-try doesn’t work in a lawsuit-happy culture. The big issue here is that LDT regulations are a mess. Assume FDA had no oversight over them, public emergency or no: our testing ramps up in early February from private labs.

Uh...Italy numbers seem to have been skewed ! ffs! “On re-evaluation by the National Institute of Health, only 12 per cent of death certificates have shown a direct causality from coronavirus...”https://www.telegraph.co.uk/global-health/science-and-disease/have-many-coronavirus-patients-died-italy/ …

Balaji once I understood that delays were occurring I intuitively knew that bureaucratic red tape & incompetence was the cause. My work has me up close with govt bureaucrats & their thought processes. Not shocked at all the pig headness at the FDA.
