In the US at least, it is the author of the code if it can be shown that they deliberately were trying to acquire users interested in copyright infringement.

US courts are *really* fiddly about "deliberately" IMO, the best defense against copyright infringement in the US is forcing the courts to define the actual limits of "limited time" IMO, it can't be more than a typical human lifetime, otherwise the law is not *experienced*.
