    NIGERIA. The largest black population in the world. A large Muslim population. A US ally, and one of the most important economies in Africa. Trump's comments about African nations being sh*thole countries were not just words. He was foreshadowing actual policy direction.

    This new 9th Circuit Title IX opinion is incredibly strong. It opens a door for students to hold liable schools that maintain a “policy of deliberate indifference to sexual misconduct that . . . heightened the risk that [they] would be sexually assaulted"

    I wish that it were enough to say that, on information and belief, a student believes s/he was treated differently on the basis of sex! I wish there were a private right of action for disparate impact (what I suspect is going on here -- assumption that disipline only affects men)

    Theoretically, the law of the land is punishing a student for sexual assault only gives rise to Title IX claim if s/he presents evidence of gender bias. But pleading standards are *so* generous here that the requirement is meaningless.

    The growing asymmetry between how courts treat Title IX suits brought by complainants & respondents is wild. This morning, read two new opinions. In one, students calling classmate "whore," "slut," etc. not sex-based. In other, school punishing student for sexual assault is.😑

    Thinking of the guy in my fed courts class who chimed in to say, during a discussion of prisons, that liberty is not an inherent good. He was recently the deputy solicitor general of an actual state.
