legal twitter: does anyone know if you can obtain the breakdown of outcomes for title IX investigations for a school? e.g. does a FOIA apply? #titleIX @amp6 @sangerkatz @sipappas @compatibilism
Hi Adam. Whose investigations are we talking about? The school itself or DOJ/OIG/etc...

ideally the schools internal investigations (hunch: schools are silencing victims, which would lead to high rates of outcomes like "complainant failed to comply")

My guess is that it will be difficult, if not impossible, to get anything from private institutions because its essentially an internal work product. I'm not really familiar with Title IX investigations; are they ever filed to any public entity?
-
ya i agree but was under impression that OCR/DoE enforces title 9 so maybe they collect this data as reported by the institutions required to do it? https://www2.ed.gov/about/offices/list/ocr/docs/tix_dis.html …

If a public agency is conducting the investigations, then the answer is yes, you can FOIA. If a private school is doing its own investigations, I think it's unlikely although maybe not impossible.

Once you get a better idea of what you want to ask, hit me back up. I file at least one records request a day and am getting better at understanding how to deal with fed/state/local agencies, and public schools. My DMs are open.
