Plain language of the Flores settlement is interpreted to mean that safe and sanitary conditions includes things like toothbrushes and showers. Gov argued that Judge Gee, who oversees Flores, modified settlement by including toothbrushes and showers. 9th circuit wasn't having it.
Judges dismissed the gov's appeal on jurisdictional grounds. Had the court found Judge Gee modified the Flores settlement agreement the case would be in its jurisdiction.
