The BIA is the highest authority within the immigration court system (which is not like the regular court system). The BIA is part of the Executive Office for Immigration Review that is, indeed, part of the Department of Justice.

I should add that AG Sessions can and has been referring cases to himself. He’s actually the highest authority here.
