RT @wimremes: hmm … how isn't it clear that O in OSF doesn't stand for FREE? <-- and it actually was free for YEARS. we just got abused.
@drbearsec @wimremes It does, but NFP use is being heavily blurred by many orgs these days. Definitely not a clear line any more.

@attritionorg@wimremes Agreed. But in your specific case, what are you accepting as Academic fair use and what are you challenging. -
@drbearsec@wimremes We have to do that on a case-by-case basis now because of the blurry lines. -
@attritionorg@wimremes Cited information from your database in a dissertation? What about a published book? -
@drbearsec Dissertation should be fine, a book is technically commercial (although we know sec books rarely make any money for author) -
@attritionorg Clearly fair use protects limited amounts of data. I was more trying to understand where you'd go to court and if it was... -
@drbearsec We haven't gone to court and will do everything we can to avoid it. But at some point, it may have to resort to that.

@attritionorg@wimremes is not the case. NFP earns income but the profit is put back into the organization vs commercial ... -
@drbearsec If they are using *our* data, shouldn't something be put back into *our* NFP org? Other than $20 I mean. -
@attritionorg Possibly. Depends on the context of use. Obviously a complete publishing of your data goes beyond fair use -
@drbearsec Exactly. So we try our best to gauge the use, and spirit of use.

@attritionorg@wimremes Also, based on previous remarks, it sounds like you are claiming any income generation makes it commercial, which... -
@drbearsec@wimremes Not necessarily *any* income. As you say "open" is messy, so is "commercial".
