@nberlat it's more like if we don't have a mystic air around the SC we lose a very fragile thread on which govt legitimacy hangs

@arthur_affect I don't know...the American ppl care about the mystic air around the Supreme Court? I'm skeptical...

@nberlat if there isn't a halo around the court then there's no reason for the next President to be scared of ignoring them

@arthur_affect Power is constrained bec there are multiple power centers, not by overarching faith. Or that was the founders' theory anyway.

@nberlat but the judiciary has no direct hand on the levers of power

@nberlat but executive and legislative might be united enough in one near term goal to spit on judiciary

@nberlat that actually almost happened w FDR and court packing and it was a fear of the resulting public legitimacy crisis that defused it

@arthur_affect Yep, but FDR's court packign was a good move; wldn't have gotten legislation through otherwise.

@nberlat but if it'd happened it would've straight up removed the court as a check and balance

@arthur_affect Not necessarily...but in any case, the outcry wasn't over mysticisim of court. It was precisely over fear of unchecked pres.

@nberlat "mysticism" may be the wrong word. The truth is SCOTUS is a pretty damn undemocratic & arbitrary system

@arthur_affect Power calculus, not sacredness of court, was what hindered FDR.
