The only thing I can think of is that at some point being Captain America meant he wasn't an active duty serviceman in the Army anymore Which is stupid

Maybe they say Captain America worked for SHIELD not the us armed forces. But it’s a made up universe so who knows.

SHIELD didn't exist during WWII. Peggy Carter and Howard Stark establish it later. There is a precursor organization, SSR, which was researching the super-soldier serum. But I think Steve was a regular army recruit seconded to them.
