      She was definitely in the US on some kind of permanent visa when she formally became an Avenger, the status quo at the beginning of Civil War The events of Civil War caused the government to try to revise this into permanent house arrest

      Which, you know, Captain America immediately called out as unconstitutional - "This is called internment!" - but constitutionality is much more flexible with non-citizens I gather Steve launched a formal appeal, which was in process when Wanda and Vision escaped

      Yea...but, given she had an official status as a semi-permenent resident it's probably very illegal. Besides under the 14th noncitizens are still entitled to due process. Although, my understanding is how much of US law applies to noncitizens a big point of contention in conlaw.

      True, but that's not what the accords were doing. Arguably you could claim they were a bill of attainder. Since it basically just sentences her to house arrest without a trial.

      Well it'd be like if the US government passed a law saying: "all people named Britney Spears must immediately be put into a conservatorship." Which would be illegal because the Constitution bans Bills of Attainder.

      Even that is probably too specific. It's blatantly illegal to put people in detention if it's not part of a criminal process. What they would probably have to do is make using powers illegal. Then wait to catch her doing that. Then jail her pending trial.

      I won't naively say it never happens [See Korematsu]. But look at the Muslim ban. It took 5 attempts over 3 years before it was legal and that was much less targeted than a ban targeting 3 people would be.

      True, but on the other hand "having telekinetic powers" is an objectively serious threat to everyone around her that "being Japanese" or "being Muslim" is not (Which is why I've always disliked the X-Men as a metaphor for racism)

          Right, it seems really obvious, from a dispassionate point of view, that the Lagos incident was an accident that should be classified at worst as reckless use of force - Wanda has no reason to *intentionally* kill civilian bystanders

          Yea, it likely wouldn't be impossible to create an anti-powers law. But it would: a) Probably have to include criminal trials. Which it's not clear the accords do. b) Repeatedly run afoul of the Administrative Procedures Act and need to be reworked prior to implementation.

          There's a book called Nemesis about an openly transgender superhero, and if the Boys TV show really wants to impress me it will actively try to question if a group of people born naturally superior to the common masses are really a good stand in for oppressed minorities.
