It's not that big a deal to me whether someone can keep on making new games explicitly set in Tolkien's Middle-Earth using named characters from Lord of the Rings and whatnot

It is a big deal if you can't use a cool game mechanic from Shadow of Mordor in any other context in any other game without paying them Specifically *because it was such a cool mechanic* they decided it was eligible for a patent

As egregious as some abuses of copyright law can be, its extremely rare that even the most obnoxious copyright holder is directly responsible for someone's death the way patent holders can be.
