I don't see what the criminal offense has to do with it - are you saying that the forced abortion is justified as a judicial punishment? For whom, the mother or the father? It's kind of a fucked up way to see the issue

The question of whether or not they are competent to make their own medical decisions is a separate question of whether a crime occurred (you're apparently skipping several steps in between here, like assuming the rapist is the child's father and she's being taken away by CPS)

There are plenty of times and places where abortion was simply illegal, period, regardless of the circumstances - the exact opposite of @cervix_envy's ideal - but those laws were opposed because they were felt to be unjust, and eventually overturned
