Yup, marriage is construed under the common law as consisting of the three Cs (consummation, cohabitation, commingling of finances)

If any one of these is missing, it's grounds to challenge the marriage is invalid for the purpose of annulment etc, if all three are then the annulment is pretty much guaranteed

Some people may fail to achieve one of these things, but it takes a true, pink-streaked, procyon rube to fail the hat trick

In Canada, for immigration purposes at least, the definition also includes monogamy. "Open marriage" is, we were told in no uncertain terms, invalid according to the Canadian Immigration Bureau.

Yeah and the definition of polygamy also draws on the three Cs The first one being the big one, as always, but they also look really askance at you having a long-term roommate, especially if said roommate is depositing their paychecks directly into your bank account

That last piece has fucked a lot of people over who were lowkey practicing polygamy in Utah etc. Insurance companies played a lead role in busting polygamists, by catching out people putting people they weren't legally married to on a joint policy

Or, like, if you weren't legally married (because it was a poly situation) then you have no legal recourse when you get "divorced" -- the money you sank into helping pay the mortgage was just "rent", the furniture you bought was just a "gift", you can't get anything back

And even if they can't prove you've actually been having sex with your "roommate", if a married couple has a roommate who's been giving them almost 100% of their paycheck the whole time they've been living there that is sufficient evidence to get arrested by the FBI for bigamy

wait even disregarding everything else, why is it a *federal* crime
2 replies 0 retweets 4 likes -
Because everyone has always hated the fucking Mormons. And frankly, like, 90% of the reasons for that are good reasons, but they were harder to make laws about, so the feds made laws about the 10% that are not good reasons.

Yeah and it had to be a federal law because the Mormons all moved to Utah in the first place to get out from under state governments that all already had anti-bigamy laws

And because the feds were extremely upset they got away with this and terrified of the idea of Utah ("Deseret") actually becoming an organized Mormon theocracy with legal plural marriage and achieving statehood

Were it not for the civil war feds would have likely violently quashed Utah
