It's not just immigration, either. In many, many legal systems, the entire CONCEPT of "what is a legal marriage" is premised on people who fuck each other, or at least intend to fuck each other. If you don't fuck? Your marriage can be declared invalid!

Yup, marriage is construed under the common law as consisting of the three Cs (consummation, cohabitation, commingling of finances)

If any one of these is missing, it's grounds to challenge the marriage is invalid for the purpose of annulment etc, if all three are then the annulment is pretty much guaranteed

In Canada, for immigration purposes at least, the definition also includes monogamy. "Open marriage" is, we were told in no uncertain terms, invalid according to the Canadian Immigration Bureau.

Yeah and the definition of polygamy also draws on the three Cs The first one being the big one, as always, but they also look really askance at you having a long-term roommate, especially if said roommate is depositing their paychecks directly into your bank account

That last piece has fucked a lot of people over who were lowkey practicing polygamy in Utah etc. Insurance companies played a lead role in busting polygamists, by catching out people putting people they weren't legally married to on a joint policy

Or, like, if you weren't legally married (because it was a poly situation) then you have no legal recourse when you get "divorced" -- the money you sank into helping pay the mortgage was just "rent", the furniture you bought was just a "gift", you can't get anything back

And even if they can't prove you've actually been having sex with your "roommate", if a married couple has a roommate who's been giving them almost 100% of their paycheck the whole time they've been living there that is sufficient evidence to get arrested by the FBI for bigamy

Yeah a lot of libertarians have hotly objected to this on principle but it's hard to gather a public outcry about the persecution of FLDS nutjobs among people who aren't themselves actually pro-FLDS and pro-sister-wives

I mean, i'm ACTIVELY pro-"revising marriage laws to allow for multiple spouses" and i still have no sympathy for the FLDS, not least because a lot of the "wives" are like fourteen.
