One of the key features of marriage as traditionally legally defined is that the spouses share implicit ownership of the "marital home" That's one of the intrinsic protections of marriage (and was once an argument for common law marriage as an institution)

Perhaps that right should also be extended to children who've not yet reached majority

Yeah, but it's a whole can of worms I see the argument now that I think about it that children should get the same consideration as spouses or tenants do re: protection from "eviction" but it's obviously complicated

Like the point being it's really important that you both own the house The law doesn't let the government just take your house and give it to someone else (well, it does, but it's a really big legal issue - squatters' rights, adverse possession, etc)
