      And wouldn’t constitute an admission of guilt? Like it would be funny if Trump rage quits, Pence becomes president, pardons Trump, Trump publicly accepts pardon, Trump gets prosecuted, and then that acceptance of said pardon is admitted into the record as evidence...

      Well, this isn't really true A pardon has no specific, clear meaning re: "guilt" or "innocence", it's just a statement the government will no longer be pursuing any action against you for your crimes

      Supreme Court disagrees for the last century. Burdick v United States, 1915. (Also, the DoJ refuses to admit they ever screw up, so their guidelines cannot admit that someone could have been falsely convicted in federal court, therefore, thou shalt not maintain innocence...🙄)

      Hmm, I actually didn't know about this This complicates the thing I vaguely heard about a while back about someone saying they rejected a pardon because they weren't guilty

      US v. Wilson (1833) apparently does say you can formally reject a pardon, although this was someone who was already convicted, sentenced and awaiting execution I'm not sure what would happen if you refused a pardon before you were even formally charged

      ... that’s the kicker. Ford pardoned an unindicted co-conspirator, but I’m pretty sure Nixon never formally admitted guilt under oath. So... it can be done. And the precedent is: dude’s a crook.

      Indicting guy who's been pardoned for things he was never formally accused of, much less convicted... would not seem to violate double jeopardy, at least. If Trump resigned and engineered a pardon from Pence, new jurisprudence could develop if Biden's AG chose to indict him.

      My understanding of the issue is that this is incorrect -- a pardon is not a part of the truth-finding legal process at all, so "new evidence" is completely irrelevant to being pardoned A pardon for a crime is a statement that the state will not punish you for it, period

      After all, the (controversial) interpretation of Burdick that says that a pardon implies guilt means that you *already confessed to the crime*, so how could finding more evidence that you did it affect the fact that you were pardoned

          Fair, but I believe Nixon maintained that all his actions as president were legal even after he accepted the pardon.

          And then add the complication of legally innocent because we’re talking unindicted coconspirators, so... there’s not even really a crime to pardon. (We have a lot of these catch 22s in the system. People of Interest don’t get public attorneys for the legally innocent reason.)
