Democrats controlled the Senate in 2013, and if McConnell had tried to permanently block Ginsburg's replacement Democrats could've nuked the filibuster for SCOTUS confirmation the way they just had for the lower courts, and as McConnell did anyway four years later

I mean, historically the argument has been "if we change the rules, then they'll change the rules when they're in power, and that will be bad." Which doesn't really apply anymore, since they already did that.
