      To be fair, the filibuster on SCOTUS nominees was still in place, so there is some blame to assign to Harry Reid, who could have removed it but didn't (or didn't announce that he would, anyway). But RBG could always make her retirement conditional on a replacement.

      I'm just really frustrated with what seems like a general insistence that *nobody* fucked up and that Democratic leaders cannot ever fail, only be failed by voters just stubbornly voting the wrong way

      It's rational and pragmatic to scold voters for voting wrong and say that that's more effective than the basic tactical understanding of timing judicial retirements that all the previous justices held themselves to?

      If anything, I think my issue with the argument here is that it's OVERLY rational and pragmatic. I'm much more capable of being persuaded that, despite all their political power, Supreme Court seats are still a job, each held by an individual with their own life.

      Ginsburg's non-retirement is far more justifiable in terms of sentiment, emotion, and personal dignity, than in any kind of pragmatic calculation. Does that make it good or right? I'd still say no. But it's why I hestitate.

      This is the actual argument people make and considering the sheer amount of power SCOTUS justices have and how rarefied a privilege it is and the incredible impact their whims and peccadilloes have on the entire rest of the world I don't give a single shit

          Yeah, fair. Like I said, I don't think it makes it good or right. But it at least makes it human, so that it's possible to be very sympathetic to RBG *even though* she made the wrong choice. But it's also the *only* grounds for sympathy. The pragmatic, rational answer is easy.

          The filibuster only exists at the sufferance of the majority! It is not a constitutional principle, and could be removed at any time. As it in fact was in 2017.
