I wonder if we could combine two of the ideas i've seen floated: - first, legislatively SHRINK the Supreme Court to 7 justices. Poof, Barrett and Kavanaugh are gone. (LIFO) - wait a few months, then expand to however many (at least 13, 1 per circuit)

I mean, this is wishful thinking since i'm pretty sure the Dems are too cowardly to do ANYTHING useful here. But it'd be practical, and entirely legal & constitutional!

Would shrinking the court actually kick the justices with the least seniority? It's a genuine question, btw. My fear would be that it's seen as uncharted territory, gets contested on who should stay and who should go, and the case works its way up to the Supreme Court.

Yeah, i don't actually know; i'm not a lawyer. Expanding is probably easier to get the political will for, anyway.

I highly doubt this is possible since it's an obvious substitute for impeachment, which the Constitution specifically says requires a supermajority
