I don't get this whole Sherlock Holmes emotions lawsuit. Can't they just say that they're writing a reimagining where he has emotions, independent of any stories where he has emotions?

Like to be serious about the point I made earlier, Robin Hood is obviously a public domain character but the genderswapped version of Robin Hood in the novel Robin: Lady of Legend is still owned by author RM ArceJaeger

That doesn't mean no one else is allowed to write stories where Robin Hood is a woman But it does mean that if I were to write a very similar novel with a similar gimmick she'd be able to sue me and force me to prove I didn't base mine on hers
