If Grimes divorces Musk and they don't have a prenup (I'm sure they do, but let me dream) don't the divorce laws in California stipulate that she AT LEAST gets half his assets, meaning she would break his control of Tesla shares?

That said, even if they were married, California's community property law does not actually say that 100% of your assets become joint assets the moment you get married, and it would probably be unjust if it did

The family court would have to decide to what degree Grimes' labor (either at the business or at home) enabled the growth of the company's value during the marriage to determine what portion, if any, of the business is rightfully hers

Ah. In Wisconsin, it would be 50/50 no matter what. Minnesota would determine based on what Grimes would *need* based on the judge's assessment

I'm *pretty* sure that ownership of a business not automatically coming under community property is a general rule in community property states, because of exactly the hypothetical you state (it would be a huge disruption for the business if the spouse was hostile)
