I personally think that CDL was a bad idea and a very shaky legal argument, although I don't personally feel extremely strongly about it What I do feel strongly about is that the Authors Guild and NWU are labor unions in this dispute and outsiders shouldn't cross picket lines
I haven't read all the supporting documentation for the lawsuit but there really does seem to be a certain amount of all-or-nothingness in the lawsuit itself. FWIW.
The lawsuit explicitly wants to shut down the whole *Open Library* It has no comment to make on the entire rest of the Internet Archive that has nothing to do with print publishing
