I think his point is that this is different because it's based on mere possession of a retail copy of the book rather than a special agreement that they paid an exorbitant price for [e.g. 4x retail price for an agreement that only lasts two years]
I remember when they started that project. They were trolling for a lawsuit then, secure in their righteousness and their belief that could create new copyright law the way they. And honestly? It was a likely enough possibility the big publishers said yeah go ahead.
It has been About 15 years,plenty of time to make their lawsuit bait project a legally distinct entity, so when they pull this crap oh, it doesn't threaten the actual internet archive.
What is shaky about it? It is as shaky as "lending books", cause it is the same thing. But if publishers want to argue that the digital books they sell are not really books, that will be interesting.
