No one is making any attempted arguments here about transformative work at all, it's a red herring (unless you're taking the Maximum Consistency dorm room argument that to allow transformative work to exist logically implies IP as a concept must collapse under its contradictions)

Okay, so: earlier you mentioned that authors should have the right to remove their work from circulation. Anne Rice should certainly be able to remove her work from fanfic consideration then, surely?

The hard line approach both sides are taking on this thing is fucking weird, quite frankly. Like, am I wrong to give my copy of bone to the kid of a single mother I know? Certainly no money goes to Jeff Smith in that transaction

Actually I've had a bit of a cough these last couple days, probably nothing but we *are* in a pandemic, phyisical copy of the book seems a bit risky in these days. Better to send a pdf, surely?

*shrug* Individual people doing minor things on a casual basis is not the same thing, or if it's qualitatively the same thing the fact that it's much quantitatively lower impact means people can and do prioritize what they get upset about

It's not a big deal for me to pay for lunch for someone if we go out and they can't afford it, that doesn't mean I can open up a tab at the restaurant and let everyone eat for free and charge it to my card

The thing people are missing here is it's not one case of someone uploading a song onto YouTube or whatever, groups like the AG push back when large organizations seek to legally expand fair use all at once, en masse, and create a new legal precedent

Right but the reason people are missing that is, by and large, because the argument has very much been centered around the "you don't deserve my work, fuck you pay me, I need to eat" one to one personal approach It's like reading first year philosophy students have an argmuent

Authors need to eat much more than any individual reader needs to read their book It's not a symmetrical situation at all

This is why I said I always instinctively lean towards the worker and not the customer in these arguments and lean on the maxim "Never cross a picket line" Even when that picket line is blocking people's access to actual groceries
