People do understand that if Uber became a real cab company that treated drivers like employees a lot of people would get fired by Uber, right And I am 100% in favor of this happening but I'm not sure they are

Of course - and in no circumstances then, can service actually be refused, and essentially, the reasonable accommodation for the *employee* has to be frictionless for the *customer*. If Uber is able to provide a different driver in the same time, say.

Or at least, if this was an ordinary taxi dispatch, they could accommodate a specific driver, at least most of the time, by sending someone else. They couldn't let individual drivers just refuse, though.
