Nope, if you accept Uber's framing that they don't work for Uber then they're self-employed entrepreneurs running their own transportation business Which makes them subject to the same laws as any other business Being a "small business" doesn't matter

The arguments that Uber drivers shouldn't be subject to ADA aren't about them being "independent contractors", they're arguing they're not really in the driving business These arguments are, most importantly, absurd, but they're bad for drivers on every other level
