This is false Uber has tried to argue this in court but no judge has agreed with them Moreover, even if we pretend this is true, then the *driver* is the "transportation company" and still must comply with the ADA https://twitter.com/ambienvalent/status/1220104316406697984 …

ADA Title III, the portion of the ADA that has to do with businesses providing public accommodations, is very clear that it applies to all businesses no matter how small If I started "Arthur's Airport Shuttle" that was just me and my car I'd still have to pick up disabled people

It sucks that Uber tries to dodge responsibility by saying their drivers aren't their employees and they're not responsible for their actions but that doesn't change the fact that the responsibility EXISTS and always exists whoever it is who owns the company

The number of people bringing out takes like "Well if he's technically self employed by Uber's definition then he's an individual not a business and none of this applies to him" That's not how any of this works

so basically they're defending the driver by... using the exact same logic uber uses to shaft the driver?

can't hold uber responsible because their drivers are independent contractors also can't hold the driver responsible because he's an independent contractor the buck passes between these parties at increasing Hz, producing a high-pitched buzz. happy ending, no one's responsible!

There's published ADA guidance from the government that specifically says an ADA obligation cannot be "contracted out of existence" It doesn't matter how many times you pass the buck around, the provider of a public accommodation must accommodate disabilities

Not unusually for them, Uber does nothing to make compliance easier for their drivers, which means that it can be an added cost they can ill afford. But the drivers aren't therefore justified in refusing compliance any more than the low wages justify mugging customers.

The definition of "reasonable accommodation" does change if physical equipment or special training is actually required But this situation required neither, and honestly if the issue is he doesn't want dog hair on his seats, I have a hard time giving a shit

Yeah, I mean, I think it's not absurd to say that the compliance costs are $0. But even being as generous as possible, and saying that it adds cleaning costs that offset the already-low wages. It doesn't actually change anything.

Maybe abstract sympathies, I don't know. I'd listen to a driver grumble about the challenges of compliance. But it's still a fuckup.
