2/ And I don’t buy into the argument that keeping the code proprietary is some kind of DRM. It’s another form of control, but it doesn’t create artificial failure states.
No matter how you cut it, they are intentionally managing the rights of their user base. Hence Flesh Rights Management.

I see now how you’re trying to connect the two by lumping them into the larger category of gatekeeping. On that I agree. To be clear I’m not a fan of closed source either, but not all gatekeeping meets the definition of DRM.

In this case it is "stolen" open source so to speak. And you did whittle down to the raw point in fact. In this "MiSTer" community specifically the crowd getting upset about "DRM" has no place to, given that the foundation of their house is built on stolen lumber & concrete.
