So you've never bought a game secondhand, then. Seriously can't tell if you're trolling.

Buying a game second hand, is NOT the same thing as downloading a ROM mate. Seriously can't tell if you are *acting* dumb, or actually are. When you buy a second hand game there is ALWAYS an initial purchase to tie back to & physical transfer. ROM dumps == 1 sale, infinite reuse.pic.twitter.com/jXKvEYyOgz

Hey Ben, I like you but the difference is legally defined in the First Sale doctrine, which specifically makes buying used a legal activity. Downloading ROM's is not. Unknown if downloading ROM's of content you own is, not sure if that's been litigated.https://en.wikipedia.org/wiki/First-sale_doctrine …

Nintendo litigated this recently, and claimed that transferring ROMS across a network is not legal.

Has there been a resolution in this case? That is a pretty stringent interpretation if it holds up.

Ouch. This is not a good outcome. Is it being appealed?

Nope.... "One of the stipulations in the judgment is the defendants waive their rights to appeal, which means this is the end of this case." http://patentarcade.com/tag/218-cv-02282-spl …

That implies concern on their part that it would get overturned...
