    Lord help us.....it has nothing to do with the EU. Gib's economy is services based. 94% of Gibraltar's EU Single Market business is with UK, only 6% is with EU27. The UK has guaranteed Gib barrier-free access to that market post-Brexit.

    In a thread from Autumn I pointed out how the UK & EU had deleted detailed Level Playing Field from the legally binding withdrawal agreement and put them in the non binding declaration ... EU negotiation document brings all of this and more on climate change back again...

    EU today also reinserted word “adequate” into description of arbitration mechanism on level playing field. In leaked UK document, change in language to “appropriate” was hailed as a negotiation win, as it meant should be able to resist binding arbitration

    This EU official implies that all questions about the interpretation of UK-EU treaties must be decided by the ECJ, because those treaties are part of EU law. That's not what ECJ case law says. Only Qs about provisions that incorporate *other* EU law must be decided by ECJ.

    Other than power, what is the rationale for a trade agreement between two sovereign entities—the UK and EU—having a provision which would see the supreme court of one of those entities granted binding jurisdiction over the other in cases of arbitration? Is there a precedent?
