Johnston is also facing criminal charges for the wilful promotion of hate.

Not directly. However, S 319 (2) cases (wilful distribution of hate) look at a body of work, rather than just one instance. It's probable this ruling will be referenced in his S 319 (2) case. I don't know when it's his next court date for that charge.
