Notably, you cannot prevent a thing from happening by passing a law against it if there is already a law against it but it is happening anyway. That is an engineering principle, and the precise reason for bringing the legal question up at that point.

It's like the observation that you can't free space on a Unix filesystem by removing a file, if there is a running process that has an open file handle on the file. Possibly you would read that as a moral condemnation of file handles, but it really isn't.
