Every time someone is deterred by the cost of fighting a case that they would in fact win, the legal system has failed, as completely as if it had produced a wrong verdict.

It would be nice to say it should be fixed. But I fear it was always so and can't be solved. We have political theories which silently assume an impossible frictionless legal system.
