In UK, any household can get a **7-pack** of rapid tests every day for free… An incredible example of what taking a true public health approach with regard to testing looks like.

"She was floating through the air, her yellow dress billowing in the wind. And then she hit the concrete right in front of me. I’ll never forget the sound of the thud because I heard it twice in quick succession; she briefly bounced."

Most federal judges don't like broad state laws that can contradict federal laws. So it will be interesting to see how an appellate court will interpret it. Appellate court will also weigh in on her "solution." This case is far from over. First act in a multipart drama. /3

Epic lost on the facts almost across board. On a federal level and if the case was brought in almost any other state in the nation, Epic lost. The judge's reliance on California Cartwright Act is wide open to appeal because it relies on her interpretation of broad state law. /2

I spent afternoon trying to make sense of the Apple/Epic ruling. So here's a counterintuitive take: Apple won far more than it lost + it has the far stronger case on appeal. All the actual factual findings are in Apple's favor. Factual findings are hard to undo on appeal. /1

Key quote: "While Apple’s conduct does not fall within the confines of traditional antitrust law, the conduct falls within the purview of an incipient antitrust violation with particular anticompetitive practices which have not been justified." THAT OPENS UP CASE FOR APPLE APPEAL

My take: has a better chance of winning on appeal than does.

Short Version of Judge in Epic-Apple ruling: Apple isn't a monopoly by any federal definition, but it engages in anticompetitive practices under California state law.

There has been healthy pressure on public companies to have more diverse boards of directors. But notes that there are far more private companies, and they are bastions of white men with remarkably little diversity:

On my feed, the images extend to edge of phone. Looks kind of like Instagram. Does everyone see this or am I part of some experiment?

While public companies have been pushing for board diversity, it’s the Sand Hill Road VC firms that have kept the status quo, nice reporting from

The responses here are crazy. Vaccinated people can transmit COVID. Especially Delta. CDC says medical facilities are REQUIRED to mask. NY requires masking (where the urgent care was — btw so does Broadway or US Open) Kids under 12 aren’t vaccinated. We went to different doctor.

Just brought my child to an urgent care center because she had a fever and I wanted to get her checked out. The doctor, nor the nurses, wore any masks. “Why would we mask if we are vaccinated?” the nurse told me. I was dumbfounded. I turned around and walked out.

Ed Asner was the greatest. I had the deep privilege of working with him briefly when he played Warren Buffett in Too Big to Fail. He was so kind and funny. RIP

They were all so young. They were all so selfless. The families of the 13 U.S. service members killed in Afghanistan are grieving deeply tonight. Please remember them. May their memory be a blessing. 🇺🇸
