Epic lost on the facts almost across board. On a federal level and if the case was brought in almost any other state in the nation, Epic lost. The judge's reliance on California Cartwright Act is wide open to appeal because it relies on her interpretation of broad state law. /2

I spent afternoon trying to make sense of the Apple/Epic ruling. So here's a counterintuitive take: Apple won far more than it lost + it has the far stronger case on appeal. All the actual factual findings are in Apple's favor. Factual findings are hard to undo on appeal. /1

Just brought my child to an urgent care center because she had a fever and I wanted to get her checked out. The doctor, nor the nurses, wore any masks. “Why would we mask if we are vaccinated?” the nurse told me. I was dumbfounded. I turned around and walked out.
