That is exactly what "merit" means: the degree to which one can be trusted to wield the mechanisms of power. Which is NOT the degree to which one deserves protection. (Bad actors often like to claim that merit is just undeserved privilege.)

It's intesting to note how people seem to conflate technical merit with social merit here, though. Note how people like Assange, Appelbaum, Marquis-Boire exploited that.

While the principles of love and purpose are somewhat eternal, social dynamics are very complex and constantly evolving, and a well-defined set of rules may sometime be helpful and sometimes create more problems than it solves.

Laws exist as well-defined set of rules in our society. Apparently because they were useful for the stability of societies in the long run. Also, we do have a data point in e.g. Marquis-Boire that there was a certain lack of rules and their enforcement in our community.
