Again, #SCOTUS historically leaves its most impactful decisions to the end of term, and we already know which way the Roe case is leaning, which leaves two options for WV v EPA: no ruling, in some effort to temper the reaction on abortion, or a sweeping ban on regulating GHGs 😬

**ban on regulating GHGs under the Clean Air Act. There is an active effort to petition the EPA to regulate GHGs under TSCA and it wouldn’t preclude Congress passing new legislation (but they haven’t managed it in 30+ years so…)

Also, reminder that this is the GOP judicial strategy at work, which entails not only stacking the bench from the district level on up with rightwing justices, but also the RAGA machine, which exists to bring constitutional challenges before those judges
