Problem is, the people did pick a president and unfortunately he's in office until January and can conduct business of the president until then, which includes picking a justice. The waiting notion is a bit silly and Garland should be a justice.

Except the president lost the popular vote by 3M, so the people didn't pick him, the Electoral College did. For that matter, Sen GOP received 14M fewer votes than Sen Dems. This is the worst illegitimate administration ever.
