Court's reasoning- despite the assembly was largely peaceful (DOJ accepted), the judge said it's a "direct challenge to the police and law and order" to defy the ban. Placing emphasis on deterrence, the judge likened the rally placed "inherent latent risk of possible violence".
The logic followed similar rulings by the Court of Appeal, which the judges find (1) events in 2019 unprecedented; (2) cases laws make less weight given to character, and rather to play up deterrence and "open condemnation" to the accused;
Hence, a peaceful unauthorised assembly will attract a 18-month sentence as starting point. That's the case for "Long Hair" Leung Kwok-hung, while trio of Martin Lee got suspended sentences with combination of age, characters and public contributions.
