I’ve seen a number of people advocate for “civil disobedience” against settled status by encouraging EU citizens to not apply for it. Many EU citizens have already stated categorically that this is a bad idea but I’m still seeing this suggestion so allow me to chip in. Thread.

First of all, this idea (in its most generous characterisation) depends on basically no EU citizens registering. If even one million register, the Home Office collective isn’t going to cry into its dinner and wonder what they did wrong. It will treat the 2 million as overstayers.

We know that many EU immigrants here will register. There is just no way to prevent it. So what you’re doing is encouraging a sizeable portion of the EU population of the UK to thrust themselves into the warm embrace of the hostile environment.

But even if you managed to get most EU citizens to refuse to register... what then? Even if you manage to coordinate the actions of 3 million people to act against their interests (lol) the Home Office is extremely unlikely to just scrap the scheme. So, again, enforcement.

I don’t know if this idea is born out of privilege or exceptionalism or ignorance but the end result of failing to register by 2020 is you become an illegal immigrant. You will not merely not have a document confirming your status. You will not have status.

That anyone would encourage someone to willingly plunge themselves into the absolute hell of the hostile environment and immigration enforcement to make a futile, counterproductive political statement is very depressing.

But the people pushing this idea are very rarely the ones who will suffer the consequences. If you are spreading this idea, tell us this. Will you pay for the loss of earnings when that person loses their job as a result? Will you shelter them when they can’t rent?

Will you pay their legal fees in fighting removal or deportation? If they ultimately cannot remain in the UK, will you compensate them for the loss of their home?

The other side of this coin are people who encourage others to apply for settled status even though they’re British. That will show them, they say. That will give the Home Office more work and cause them misery. A noble political protest.

EU citizens have gone on record in scores to say that they don’t want this. They’ve said that all this will do is cause delays to them, compounding the uncertainty, and perhaps overload the HO to the point that their decision making suffers. I agree with each point.

Yet people still suggest it. I even saw one person, in reply to an EU citizen begging for these requests to end, say “well, I think you’re wrong so I’ll still do it”. FFS. You’re messing with people’s lives, people who have been living in agony, just to try and stick it to Javid.

These people couldn’t care less about what EU citizens need or want. All they care about is their own (probably justified) grudge against the government. But they gamble with others’ lives and not their own. If you see this, call it out.

You are right, one way to effectively protest/disobey is to refuse the EU simplified process and fill to "old" residence permit request still valid to any foreigner (including EU). This would paralyse HO while you have a proof of application.

What’s the “old” residence permit request? You mean just a non-EU application for leave to remain? Or do you mean a PR application under the old EU rules?

The application for leave to remain. AFAIK it is not specific for non-EU, but EU "benefit" from the new streamlined process.

The non-EU application for leave to remain costs £2033. I assume you meant something else?

I'd rather that all 65m EU citizens in the UK should apply for settled status, just to overload the system, and see it abandoned as unworkable.
