I'd like to take a little time to talk about why @NAACP_LDF, @LawyersComm, @PRRAC_DC, @ssamcham @TexasAppleseed @TexasHousers @natfairhouse @ACLU @Public_Citizen suit against #HUD from this morning is so important. (thread)
The suit concerns the Affirmatively Furthering Fair Housing regulation, which HUD issued in 2015 to give effect to a 50 year old provision of the Fair Housing Act which affirmatively requires HUD and jurisdictions that receive money from HUD to reduce segregation.
Of course, the part of the Fair Housing Act is important because it seeks to remedy, what is now, over a century of discrimination in housing, including explicit segregation by federal, state, and local governments.
But the piece of federal law at issue is uniquely important and powerful. Most protections in American law are negative; that is, they say what the government cannot do to you. For example, the Bill of Rights provides you can't be denied free speech, due process by the state.
The AFFH provision places an affirmative obligation on the government to go forward and fix a history of discrimination, not just that one can't be discriminated against in the future.
That the AFFH provision does this, doesn't undercut its legitimacy, but rather speaks to the gravity of the harm that it seeks to redress. Our history of segregation is so long, prolific, and harmful that Congress recognized the only way to fix it was to require HUD to fix it.
That it has taken us more than 50 years to do so (and that despite this, HUD continues to drag its feet), is shameful and is why this suit is so important.
Even with progressive & seemingly protective landlord/tenant laws on the books, tenants are 2 often prey 2 slumlords like #JaredKushner & #SeanHannity - the real welfare queens. The rest of us are just trying 2 survive.
Meanwhile, they get preferential treatment in homeownership.
This is why #renters need people like yourselves. The academics, the advocates, the politicians and especially the lawyers who aren't afraid to take on this administration; Because - when we do it - we get harassed, retaliated against, and even evicted, like myself. We need help.
So, yeah - this is a legal enema. It's past time for a spotlight to be focused on #HUD, to show it for the useless dept. it has unfortunately become. If Carson is allowed to continue in this vein, #homelessness will increase, exponentially.

As a long-time tenant advocate, and personal recipient (victim) of HUD #housing programs; I can attest to how their (@HUDOIG and @CivilRights included) apathy and many failures over many years (even pre-Carson) have resulted in the current #HousingCrisis.
