The AFFH provision places an affirmative obligation on the government to go forward and fix a history of discrimination, not just that one can't be discriminated against in the future.

That the AFFH provision does this, doesn't undercut its legitimacy, but rather speaks to the gravity of the harm that it seeks to redress. Our history of segregation is so long, prolific, and harmful that Congress recognized the only way to fix it was to require HUD to fix it.

That it has taken us more than 50 years to do so (and that despite this, HUD continues to drag its feet), is shameful and is why this suit is so important.
