        So Roberts might actually be aware of the legacy of the "Roberts Court"; he might also be stockpiling subtle wins for Dems in exchange for the big fireworks later re whether Trump can be subpoenaed. Love to see @JeffreyToobin weigh in.

        Jones v Clinton and US v Nixon are going to make it very hard for SCOTUS to rule that you can't subpoena the sitting President. Even a right wing SCOTUS.

        That’s why he chose Kavanaugh over the other Federalist Society candidates but he is not going to get Roberts (or Gorsuch, in my opinion) to overturn those two cases that easily.

        Not necessarily. Kavanaugh might have voted with the three dissenters but not wanted his vote to be public. This order doesn't mean it was 6-3; it could have been 5-4.

        One must also wonder why, if Kavanaugh would've voted in favor of a stay, he wouldn't want that to be made public. There's no downside for him. It was 6-3.

        I think it has to do with a proposed question Trump & Co want to add to the 2020 census. It's a citizenship Q and the fear (and possible purpose of) is that it will discourage people from answering the census and maybe voting in future. My limited understanding

        SCOTUS ruled years ago that you had to count everybody (legal or not) for apportionment purposes. So there is no "need" to ask the question (which will otherwise inhibit respondents and lower the count in places with a lot of undocumented residents . . . like urban areas.
