    Attorney General Barr purported to give John Durham the protections of "special counsel" status under the DOJ's regulations, without actually appointing him pursuant to those regs. He wants the benefits without bearing the costs. Then again, who doesn't?

    Durham like Mueller was not appointed pursuant to SC Regs but rather pursuant to general AG statutory authority and, like Mueller, only 600.4-.10 apply to him. Barr copied the approach used w Mueller so .3 doesn’t apply.
