It's certainly odd how he considers a paragraph that cuts right to the chase of the ethical frontier that Justice Hayden is planning to cross with this judgment as "not engaging with the facts of the case"
He then quote's the Pope's letter urging caution to avoid overzealous treatment as a "comprehensive answer" to Prof Hass' "tendentious views" - but I must have missed the part where the Pope said he supports overruling the wishes of a child's parents regarding end of life care
Which of course was the crux of Professor Hass' "tendentious" and "inflammatory" paragraph
I'm not surprised that Justice Hayden is now rejecting the Pope's tendentious and inflammatory offer to bring Alfie to Italy. I mean, how dare he demonstrate that he really didn't mean what Justice Hayden wanted him to mean.
The way the cult of expertise works is that Professor Haas is now referred to as the "discredited German doctor who inappropiately used the case as a platform for his views" and Hayden is extraordinarily thoughtful for using the Pope's words to justify his own views.
