it's the same idea in two different rhetorical modes (both have their place)

I do think there’s a substantive question of Toleration vs Indifference there; you can be willing to tolerate a certain degree of false convictions but you should never be indifferent to them.

the degree to which i will tolerate rape, lest a boy accidentally be punished who was "just having an innocent good time," is extremely small

By no means am I saying to tolerate rape; like I said it’s good to tolerate a certain amount of judicial error so that we can punish criminals and enforce justice. I’m saying indifference to the punishment of the innocent is a terrible thing, ethically and practically.

oh yeah it's not an indifferent matter: i just don't trust people who choose to expend the lion's share of their emotional energy worrying about it

I do think that punishing the innocent is worse than not punishing the guilty, all other things being equal, so it might merit outsized attention (maybe not the lions share)

Though caring at all about it requires a similar degree of care for people who are being raped ofc

You seem to be making the same mistake as feminists which is assuming that the fallout of the sexual revolution requires ramping up of punitive justice as opposed to bringing back the commonsensical norms that governed the fraternization of young adults

You do this by administering punitive justice on those who do wrong

Not really, you do it by bringing back in loco parentis, 10 pm curfews and chaperones

Yes, who is arguing otherwise? I'm specifically responding to the original guy's argument that innocent men should be punished to end the rape epidemic. It's draconian and heavy handed especially given all the harmless mores we've abandoned that would be more effective
