Roberts writes the 5-4 decision: "Here the agency failed to consider the conspicuous issues of whether to retain forbearance and what if anything to do about the hardship to DACA recipients." The case is remanded back to DHS "so that it may consider the problem anew."pic.twitter.com/vj8Zp43n7N

This outcome is similar to what happened in the census citizenship question case — in both cases, Roberts wrote for the majority of the court that the Trump admin *could* in theory do what they were trying to do, but that officials had gone about it in an unlawful way

NOW: The Supreme Court Ruled The Trump Administration Violated Federal Law When It Ended DACAhttps://www.buzzfeednews.com/article/adolfoflores/supreme-court-daca-trump-ruling …

Aside from the fact that this ruling leaves DACA in place, it's also significant that the majority found the DACA recission was the type of exec branch action courts could review — the Trump admin argued the courts couldn't weigh in on something like this https://www.buzzfeednews.com/article/adolfoflores/supreme-court-daca-trump-ruling …pic.twitter.com/oYj9XDEAzN

This jurisdictional issue is important b/c it relates to the broader authority of courts to review immigration policy. Roberts: just because a policy relates to deportation does not mean the laws restricting when courts can review *individual* deportation decisions autom. appliespic.twitter.com/D94CRn7UA7
