This is how laws in the US work. It's set up in a way to minimize damage of the 'victim'. Regardless of it be factually correct.
Not quite. But that is the problem that anti-SLAPP laws are designed to fix. And the SPEECH act prevents any foreign court orders from being enforced locally if they don't hold up to US free speech standards.
This isn't a legal matter. YouTube's terms and conditions state that it is at their discretion what they deem defamatory. So even if it's not legally, they might still claim it is.
