If Shadow, Inc. and the Iowa Democratic Party want to reestablish trust, then they should... 1) Publish a detailed technical post-mortem of last night's failures 2) Allow for critical technologists and academics to examine their system Both are standard in Silicon Valley.

  7. We’ve also seen institution-driven restorations of congressional power, like the legislative reorganization act of 1970. So it can happen! But agree the trend now seems to be towards the executive branch and the states.

  8. Another factor that may be relevant is the shift in the judicial branch towards the right in the Trump administration. Will this mean they reconsider Chevron or non delegation doctrine? That could be a big factor in how important Congress is going forward.

  9. I also think the piece overlooks the significant opportunities to impact innovation plicy through appropriations, NDAA, and other bills that happen every year (or periodic agency reauthorizations or statutory sunset provisions).

  10. This is particularly true in innovation policy, which is essentially premised on new entrants coming in and disrupting old incumbents. The latter, of course, tend to be more politically powerful. Making reform hard in a body like Congress.

  11. OTOH, the pluralistic deliberation of Congress. with its many stakeholders, is inherently slower than top-down executive branch decisions, or even judicial ones. It’s not new that major legislation (e.g. updating the telecom act, new privacy laws) can take years to happen.

  12. For instance, the significant shift of power from committees/rank-and-file to leadership is arguably a major factor in this dysfunction.

  13. This trend can be partly attributed to decreases in staff capacity (e.g. at OTA, committees, CRS, GAO, and personal offices). But is also related to norms and rules in each chamber, the changing media landscape, how campaigns function, and other issues.
