Sometimes when I do an interview in Spanish I spend a significant amount of time thinking about how that person would never be interviewed, or how different the interview would be, if they weren’t contacted by a bilingual reporter. And that hits.

Overall, Florida has now spent nearly $40,000 to relocate each migrant from San Antonio to Martha’s Vineyard. To put this into perspective, if I was a San Antonian and wanted to make the trip on Valentine’s Day, it’d only cost $328.

Now we don’t know the nature of the workforce in Half Moon. We don’t know motive. There’s a lot to be learned about this specific incident. But what is concerning to advocates and officials is that this is already a vulnerable population that is now further exposed.

Political options floated as solutions: - pathway to legalization for workers - abolishing labor contractors - increasing DOL funding - states pass their own laws Buuuut immigration related bills are unlikely to move in this congress and agencies have limited resources.

Think about the range. We are talking anything from wage theft to human trafficking all in one sector. Even if workers know their rights — they have to be encouraged to speak up. Even if they do speak up there have to be the resources and enforcement. There are gaps here too.

Okay so we have a largely undocumented population. They are least likely to speak up if there are signs of violence from coworkers or employers because they fear loosing their jobs, housing, care, and ability to be in the US. Violence and violations can happen at multiple levels.

Farm labor is really difficult for federal and state agencies to regulate. Even if the laws are in place, workers may not know their rights or which rights apply. And DOL and state agencies struggle to keep tabs of every farm due to limited resources and the remote nature.

Workers can be contracted through the farm itself or hired through a labor contractor. There are federal laws for workers but many OSHA, wage, unionization laws don’t apply to farmworkers. Some states have their own union/overtime/heat laws but it’s few.

Let’s start w the basics. Farm labor largely takes 3 forms: undocumented, documented & H-2A visas. Visas are limited to seasonal ag. So things like dairies and mushroom farms that require year around work as opposed to a harvest season don’t get them. Nearly 50% is undocumented.
