Today, I am proud to have fulfilled a significant campaign promise, as we announced the launch of a Post-Conviction Unit and an Innocence Commission. When someone has been wrongly convicted, it is incumbent upon prosecutors to correct that injustice.https://www.sfdistrictattorney.org/press-release/formation-of-post-conviction-unit-and-innocence-commission/ …

So basically you are turning the DA's office into a second Public Defender's office.

You think it's the responsibility of the Public Defender's Office to clean up the mistakes of the DA's office?

Why yes, yes I do. And our well-funded, expertly-staffed Public Defender's office is perfectly suited to the task.

The Public Defender's Office only represents a subset of defendants while the DA's office is responsible for all of our local prosecutions. Not sure how it makes sense for the PD to be responsible for the huge number of cases that never even make it to them.

What's the proportion of cases the PD handles?

I don't have stats on SF. LA Public Defender handled 70% of felony cases and 55% of misdemeanor cases in 2009 (https://scholarlycommons.law.cwsl.edu/cgi/viewcontent.cgi?article=1078&context=cwlr …). A casual search shows that's largely on par with most cities.

Great! Since the focus is on felonies, PD is already familiar with 70% of the cases. I doubt many with the resources for private representation were wrongfully convicted.

Actually, PDs in San Francisco are better at indigent defense. https://www.capolicylab.org/wp-content/uploads/2018/11/Policy-Brief-Comparing-Indigent-Defense-Yotam-Shem-Tov-Nov-2018.pdf … To be clear though, many defendants have court appointed private attorneys as opposed to public defenders for conflict reasons, not because they're wealthy.

And San Francisco Deputy Public Defender Jacque Wilson will be on the commission & provide input from the PD, but they already have a huge caseload. If you have a law degree, you’re welcome to run for DA or PD in 2023 and propose to do it the way you want.
